Dream Sports Park repairs a legal nightmare

Gilbert is paying for $1.6 million in repairs to the Big League Dreams Sports Park, although town officials continue to seek repayment from the builder, Srianthi Perera at The Arizona Republic reports.

Work to modify the seating to eliminate tripping hazards involving all eight fields and to ensure stadium stairs, handrails, ramps and other structures comply with the Americans with Disabilities Act began last week. The work should be completed by December.

Officials used money from the town’s general fund to pay just under $1.3 million in construction costs, plus $183,000 for pre-construction services and $175,000 for seats.

Town officials and the company have been tangled in the legal battle since early 2013. Gilbert has spent about $166,525 on the litigation through June, according to a town spokeswoman.

By last spring, Mortenson asked the court to rule that Gilbert lacked the right to even seek money for repairs, noting the town had contracted with a private firm, Big League Dreams USA, to operate and maintain the complex.

On Aug. 5, Superior Court Judge Mark Aceto declined to rule on Mortenson’s requests.
