Don’t bark up the wrong custody tree; get a ‘pup nup;’ Chairman of Rose Law Group Family Law Department Kaine Fisher says courts don’t treat pets same as humans

Attorneys across the country are reporting a huge jump in pet custody battles, which can be both emotionally and financially draining.

But now, there’s another option: the pet “pre-nup.”

Many people treat their pets as if they are part of the family, but what happens if the family breaks up?

“They will fight to the death for these animals,” animal rights attorney Gina Calogero said.

“They’re often looking for things to fight over and the pet is huge,” attorney Ann-Margaret Carrozza said.

“This may sound ludicrous to some, but to others, pets are like children. I don’t fall into the latter category but I can certainly appreciate how someone might get attached to their pet over time.

” Just as with anything you hold dear to your heart, or that has substantial value, it is always wise to do everything you can to protect those things.  It’s a hard pill for clients swallow that courts do not handle pets the same way they do children.

“That’s just the way it is so if you don’t want Spike being treated like a couch or toaster in your divorce then plan ahead.
