Social splitsville: Judge rules woman can file for divorce via Facebook; Rose Law Group Partner Kaine Fisher has questions

A New York City woman can legally file for divorce from her husband via Facebook, a judge has ruled.

Manhattan Supreme Court Justice Matthew Cooper said that a nurse named Ellanora Baidoo can serve her husband with divorce papers through a Facebook message, according to the initial report by the New York Daily News.

“I have seen judges get creative in permitting alternative means of service when dealing with a defendant who is being intentionally evasive, but this takes the cake.

“I suppose if the wife’s attorney has used due diligence by exhausting all other reasonable methods of effectuating service, then permitting the attorney to use this obscure form of ‘service by publication’ may be a plausible solution. I am interested, though, to see if the husband challenges whether this constitutes appropriate service under the law, and, if so, such service woulf be deemed proper by a higher court.”
