Pinal County civil forfeiture suit heating up

A lawsuit central to the civil asset forfeiture debate in Arizona will see progress this month after months of stagnation.

U.S. District Court Judge Diane Humetewa on Monday ordered plaintiff Rhonda Cox to outline any effect recently signed legislation may have on her case against former Pinal County Sheriff Paul Babeu, former Pinal County Attorney Lando Voyles and other Pinal County officials. That memo is due in two weeks.

At stake are motions to dismiss the case filed by the defense in October 2015. The parties have been waiting for Humetawa’s decision on those motions ever since.

Neither side’s counsel immediately returned a request for comment on the order.
