Claim emerges against Scottsdale land-use change

The city of Scottsdale may be facing a lawsuit alleging it acted unlawfully when it allowed McDowell Mountain Back Bowl LLC to alter its plan to build a 128-lot community coined Sereno Canyon.

One homeowner who purchased a 2-acre lot at the site says those actions — that ultimately changed the overall density — adversely impacted the property value of his land, as well as lots owned by others in the area.

Under the guise of Proposition 207, Ramras Law Offices filed a notice of claim, a typical precursor to a lawsuit, with the city of Scottsdale on behalf of Corn Investments Jan. 2 seeking damages alleging Scottdale City Council acted “in violation of the due process rights of the resident and other citizens… .”

Proposition 207 allows private landowners to seek just compensation when his or her land experiences a diminution of value as a result of any land use law enacted by a political subdivision, according to ARS 12-1134.
