Wall setback requirements irk Paradise Valley residents

The Paradise Valley Planning Commission has recommended the town consider allowing existing residential walls to remain when major renovations are pursued by homeowners — despite being in violation of adopted zoning provisions.

Setback requirements for residential walls and fences are apart of Article X of municipal code regulating height and area regulations within the town’s zoning ordinance.

Current wall setback requirements were originally adopted about eight years ago, which among other things, required new walls to meet increased standards, town officials say.

The planning commission issued its recommendation Nov. 13, which passed by a 5-to-2 margin, records show.

The crux of the issue is a homeowner seeking renovations resulting in 50 percent more square footage on his or her property would have to, in certain cases, tear down the existing wall due to the increased residential setback requirement adopted in 2004, residents say.
