I am writing in response to the rapid pace of events in the last few weeks with respect to same sex marriage in our state. While I share the enthusiasm that this surge of long-awaited unions and recognition has engendered, I am also very cautious regarding the road ahead.
There has been far too much reliance in our news coverage on an attorney general’s advisory opinion and the willingness of county clerks to act guided by their hearts as well as in some cases by limited district court decisions. An attorney general’s opinion is just that. It does not have the force and effect of law. Judge Sarah Singleton’s order directed to the Santa Fe County Clerk did not legalize same sex marriage.
