Judge denies former Cave Creek manager’s injunction request

A Maricopa County Superior Court judge denied a request for a preliminary injunction that could have invalidated the vote by Cave Creek Town Council terminating former Town Manager Usama Abujbarah.

Judge Douglas Gerlach denied the request by Abujbarah and his lawyer Daniel Bonnett to have the town rescind the motion that resulted in Abujbarah’s firing by the council at a special meeting on June 10.

Gerlach also denied a motion by Cave Creek lawyer Michael Rubin to dismiss the case, based on a procedural rule that requires the court to assume the truth of facts alleged in the complaint for purposes of such a motion.
