Maricopa County’s top prosecutor is asking a judge to clarify a ruling that allows use of medical marijuana extracts, AP reports
A Maricopa County Superior Court judge ruled March 21 that the state’s voter-approved medical marijuana law authorizes qualifying patients to use extracts adapted from marijuana.
Judge Katherine Cooper’s ruling said that means a 5-year-old Mesa boy with debilitating seizures can be treated with marijuana extract.
County Attorney Bill Montgomery’s clarification motion says it’s not clear whether the law’s quantity limit of 2.5 ounces applies to the amount of extra obtainable from 2.5 ounces of marijuana or to 2.5 liquid ounces of extract.
Montgomery says the clarification is needed so law enforcement personnel know whether an amount of extract is within the law’s limit.
