Judge tosses Cave Creek recall effort

Cave Creek councilmen are safe from a Nov. 4 recall election, based on a Maricopa County Superior Court ruling this week.

Superior Court Judge Robert Oberbillig ruled certain petitions to recall Councilmen Mike Durkin and Charles Spitzer were filled out incorrectly. Therefore, there are not enough valid signatures to place the matter on the November ballot, said Carrie Dyrek, Cave Creek town clerk.

The recall petitions were filed by the political committee Cave Creek Caring Citizens. The committee also filed recall petitions for Vice Mayor Adam Trenk and Councilman Reg Monachino. But Trenk and Monachino filed a challenge in civil court and a different Superior Court judge also ruled that the way the forms were filled out did not fulfill statutory requirements.
