The developer that brought Zinburger and Lo Lo’s Chicken and Waffles to Gilbert could face a $200,000 penalty for missing a town-imposed deadline.

The agreement between LGE Design Build and the Town of Gilbert stipulated that the two new restaurants were supposed to open by Sept. 1, 2014.

Zinburger Wine & Burger Bar opened in late October, and Lo Lo’s Chicken and Waffles is expected to open at the end of January.

“While we are very happy with the quality of what’s been put in place there and very pleased with the quality of the establishments that have located there, technically miss the deadline per the terms of the agreement which triggered some penalties for doing so up to $200,000,” Gilbert Manager Patrick Banger said at a December town hall meeting.
