I don’t think society should treat smoking pot as a criminal offense.
On the other hand, I don’t think the law should be incoherent or hypocritical. That undermines the role of the rule of law in maintaining civil order.
Passage of the initiative recently filed creating a commercial marijuana industry in Arizona would make the law more incoherent and hypocritical. There’s a vastly simpler way to make smoking pot no longer a criminal matter.
