The Arizona Court of Appeals reversed a lower court’s decision on Thursday, saying it is OK for Mohave Electric Cooperative to burn trash for renewable energy.
Utility regulators had agreed a trash-burning facility in Maricopa County would meet state renewable-energy rules, but the Sierra Club successfully stopped the project in Superior Court in 2013.
Thursday’s decision reverses that ruling and acknowledged the Arizona Corporation Commission’s authority over such matters.
