An opinion issued by the Pinal County Attorney’s Office says Rita Nader can remain on the Central Arizona College Governing Board even though she doesn’t live in the district she now represents.
The opinion was issued in response to a complaint filed by the group Citizens for Fair Taxation questioning Nader’s eligibility to hold office.
The complaint letter originally was sent to County Recorder Virginia Ross, who referred it to County Attorney Lando Voyles. The committee asked Ross to investigate a claim that Nader, who represents District 4, does not live in the district and therefore does not meet the residency requirement pursuant to Arizona law. Because of this, the committee claimed she is unqualified to hold her current board seat.
