Attorneys for Central Arizona College have filed a motion in Pinal County Superior Court seeking dismissal of a lawsuit brought by Garland Shreves, who alleges the college’s Governing Board violated the state Open Meeting Law on May 19.
The attorneys argue the board wasn’t properly served and board members have immunity from such lawsuits.
In the motion that was signed by Jennifer MacLennan, one of three attorneys representing the college, she writes, “the complaint should be dismissed because of insufficiency of the service process” and adds that “to properly serve a governing board of a community college district, each member of the board must be served.”
