Republicans and Democrats are going to keep their preferred — and exclusive — spots on Arizona voter registration forms.
Without comment, the U.S. Supreme Court on Monday refused to disturb lower court rulings, which upheld a 2011 Arizona law that only the two parties with the highest number of adherents get to be listed on the forms. The justices rebuffed contentions of the Arizona Libertarian Party that the practice is both unfair and illegal.
Comment by Rose Law Group litigation attorney Logan Elia:
This law may be Constitutional. But it is also an underhanded cooperation between the two largest political parties that ought to be repealed. The two party system is entrenched enough without using the force of law to conceal third party options. Under the current law, the two major parties are listed on the voter registration form. Anyone wanting to register a different affiliation is allowed a line less than one inch long to write in. It is difficult to imagine any compelling reason why the form needs to be this way.
