Former Humane Society employee v. City of Prescott: Court focuses on destroyed emails

By destroying emails that might have been relevant to the case, the City of Prescott leaves a future jury to infer that “the truth would have hurt you,” according to a 9th Circuit Court of Appeals judge.

That was one of the messages delivered by 9th Circuit judges Monday, March 14, during a hearing on the lawsuit that pits former Yavapai Humane Society Marketing Director KayAnne Riley against the city and former Prescott Mayor Marlin Kuykendall.

The 9th Circuit Court, based in San Francisco, conducted a hearing on the appeal that the city filed in 2014 over a U.S. District Court ruling that Kuykendall was not entitled to qualified immunity in the matter.
