Johnson Utilities asks for rehearing

Johnson Utilities is seeking a “rehearing” of the Arizona Corporation Commission’s decision to consider a complaint brought by the owner of The Golf Club at Johnson Ranch.

JU argued the ACC has no jurisdiction over the company’s treated sewer effluent, which The Golf Club wants to continue receiving. If JU stops selling the golf course treated effluent, as it has for 10 years, the course’s water bill would soar to five times the current price, likely driving it out of business, the golf course’s attorney has said.

Craig Marks, attorney for Swing First Golf LLC, owner of The Golf Club, said in an email Friday that the parties had a procedural conference this week, and he will be working with JU’s attorney to see if they can stipulate some facts.

JU said earlier this year it plans to recharge effluent into the ground for credits. But Marks has said Johnson’s real aim is to drive a competitor out of business while continuing to provide effluent to its affiliate Oasis golf course.
