Goldwater Institute case: Lawsuit over Pima County’s space balloon deal moves ahead

The fourth and final count in a lawsuit against Pima County over its deal with space balloon company World View can move forward, Superior Court Judge Catherine Woods has ruled.

Denying the county’s motion to dismiss, Woods wrote in an Oct. 14 ruling that plaintiff Richard Rodgers, represented by the conservative Goldwater Institute, has “alleged sufficient facts … to state a valid claim for a violation of the gift clause.”

The gift clause is a constitutional provision that bars government entities from giving or lending “its credit in the aid of, or make any donation or grant, by subsidy or otherwise, to any individual, association, or corporation.”
