Superior Court sides with Scottsdale in athletic club eminent-domain case

Scottsdale’s eminent-domain lawsuit against a local tennis club owner who refused to sell property for a fire station is headed to the Arizona Court of Appeals after a Maricopa County judge ruled that Scottsdale can take “immediate possession” of the land.

Robert Hing, owner of the Scottsdale Resort and Athletic Club, on Oct. 25 filed an appeal of Judge Daniel Kiley’s September ruling that would allow Scottsdale to move forward with condemnation of about 1.5 acres of vacant land near Indian Bend and Hayden roads.

Kiley on Oct. 11 declined to hear new charges from Hing, who now claims Scottsdale officials violated the City Charter in planning to build a fire station on his property. Kiley instead upheld his opinion that Scottsdale is justified in taking the land.
