Governor Ducey extends ‘stay at home’ order, with modifications

By Thomas Galvin | Attorney at Rose Law Group

Governor Ducey extended his “Stay home, Stay healthy, Stay connected” executive order just one day before its April 30th deadline. The executive order is now in effect until May 15th, but there are important modifications.

Beginning on Monday May 4th, retailers, who have not been listed as “essential services”, and who are involved in the sale of goods, “may operate and offers goods” via the following means, “provided they establish and implement protocols and best practices” to address Covid-19:

  • Delivery service
  • Window service
  • Walk-up service
  • Drive-thru service
  • Drive-up service
  • Curbside delivery
  • Appointment

Beginning on Monday May 8th, retailers, who have not been listed as “essential services”, and who are involved in the sale of goods, “may open, operate, and offer goods for sale to customers in their stores” as long as they “establish and implement protocols and best practices” to address Covid-19.” They must facilitate physical distancing and spacing of individuals of at least six feet.

Retailers located inside shopping malls may operate through delivery or curbside pick-up or appointments. Theaters, gyms, restaurants, and bars are not eligible under this new executive order to enact these relaxed policies. Restaurants are limited to delivery and take-out service.

Arizona is still under the Governor’s stay-at-home order. Residents are only allowed to leave their homes in order to obtain medicine, food, exercise, or other “essential activities.”
