Rose Law Group Cannabis Attorney Jonathan Udell comments on Pima County dismissing marijuana charges

TUCSON (KVOA) – With the legalization of recreational marijuana on the horizon after Proposition 207 passed last week, the Pima County Attorney’s Office announced that it will dismiss all pending cases simple possession for personal use of marijuana on Tuesday.

After voting against legalizing recreational marijuana in 2016, voters came out in droves on Nov. 3 to show their support for Prop 207, which will allow an individual over the age of 21 to possess up to an ounce of marijuana and make the drug legal to sell if you have a state-issued license.

“The decision to start dismissing marijuana charges is smart politics, smart public administration, and the right thing to do. Gallup’s public opinion poll this week registered 68% approval for marijuana legalization, the highest number ever recorded. As the 2020 election made clear, Americans of all stripes support marijuana reform, from New Jersey’s metropolitan residents, to Mississippians in the deep south, to South Dakotans living in the Great Plains. These voters recognize that prohibition is unjust, funds drug cartels, and distracts law enforcement from focusing on the enforcement of laws that protect society. The dismissal of marijuana charges by PCAO will allow it to focus on enforcing laws that keep Arizonans safe from those who wish to do them harm.

As soon as Prop. 207 becomes law, all Arizonans will be entitled to the dismissal of pending marijuana charges against them, whether they live in Pima County or not.”
