The city of Yuma and Yuma County have emerged victorious in a federal lawsuit claiming that the U.S. Bureau of Reclamation did not follow the required environmental process required by the National Environmental Policy Act before allowing the transfer of water from the Colorado River to the town of Queen Creek in central Arizona.
“We did get some good news this evening right before coming down here…It appears we won that case today,” announced Acting City Administrator Jay Simonton during the council meeting on Wednesday.
“Right now what that means is Reclamation has to go back and do the full blown environmental assessment of the water transfer. So that’s very, very good news,” Simonton said.
However, Simonton “fully” believes that the ruling will be appealed to the 9th Circuit Court of Appeals in California.
