PHOENIX (AZFamily) — The battle over a Biden administration policy is now playing out in the courts after a federal judge in Texas ordered a stay on the ‘Keeping Families Together’ policy Biden announced through executive action over the summer.
“Probably the most significant executive order regarding immigration we’ve seen, maybe since DACA,” said Rose Law Group immigration attorney Darius Amiri.
Amiri says dozens of families have already reached out to him about the program, which would allow noncitizens who are married to U.S. citizens or stepchildren of a citizen to stay in America while going through the green card process, which could take years.
“What that does is, it then allows them to apply for adjustment of status here in the United States without having to leave the country and separate from their families for an extended period of time,” explained Amiri.
To be granted parole under Keeping Families Together, a person must have been in the U.S. for at least 10 straight years, have no disqualifying criminal history, and undergo background checks.
But some Republican attorneys generals argued the program would cost too much money and incentivize illegal immigration.
On Monday, a federal judge issued a stay to give the court more time to look into the policy.
