Ahwatukee golf course owner wins Club West case

A Maricopa County Superior Court judge today ruled against a group of Club West homeowners  seeking to permanently restrict redevelopment of the former Club West Golf Course, ending over four years of litigation over the future of the 164-acre property.

In a 10-page ruling dated Jan. 15 but filed today, Judge Suzanna C. Pineda denied all claims brought by the Club West Conservancy, which argued that the golf course property must remain a golf course or be returned to open state under the recorded covenants, conditions and restrictions governing the site.

The judge concluded that the homeowners lacked legal standing to enforce the golf course’s governing documents and that the claims were also barred by a prior lawsuit dismissed with prejudice.
