Attorney General Kris Mayes is once again challenging the Arizona Corporation Commission, this time over its decision to repeal the state’s energy efficiency standards.
Mayes filed a rehearing request to the ACC on Monday, arguing that its July 8 decision repealing the rules “rests upon a flawed legal interpretation and inaccurate representation of facts and must be reversed and reheard.”
The standards required certain electric utility companies to achieve 22% in energy savings by 2020. Most of the regulated utilities exceeded that benchmark — a fact commissioners noted in doing away with the rules.
“Traditionally, we’ve seen mandates like this as a blank check to utilities,” Commission Chair Nick Myers said during the July 8 meeting. “Anytime you tell them what to do, they will recover on it.”
