Charles Montoya, Avondale’s former city manager, has filed a notice of claim against the city and the mayor, accusing them of breaching his employment contract and defaming his character.
Attorney Stephen Montoya, not related to former City Manager Montoya, served the claim to the city June 21, the documents show. Montoya seeks restitution of $6,875,000, in addition to $7,500 in attorney fees.
The Arizona Republic obtained the notice of claim through a public records request. A notice of claim can be a precursor to a lawsuit.
The city declined to respond, stating that it does not comment on pending matters, a city spokesperson said in an email.
Neither Charles Montoya or Stephen Montoya immediately responded to inquiries about the claim.
In December, Mayor Kenn Weise listed five reasons for firing Montoya, from financial concerns to living outside the city as required by the city charter.
The letter stated Montoya sought tuition reimbursements improperly, received overpayments in vehicle reimbursements and was 90 days past due on his retirement loan.
The city also asked the Arizona Attorney General’s Office to investigate the issues detailed in Montoya’s letter of termination.
