Constitution, ruling cause commission to pull plug on consideration of electric deregulation, says Court Rich, director of Rose Law Group’s Renewable Energy Department

In a sudden turn of events, the Arizona Corporation Commission today voted to end the discussion to open the state’s electricity market to competition.

But the commissioners left open looking into related issues, such as discussing technological innovations in delivering electricity.

The decision was made after commissioners received legal advice saying electric retail faces constitutional impediments, and that the Arizona Constitution likely would need to be changed to deregulate the energy market here.

Deregulation critics immediately praised the commissioners for pulling the plug on electric retail.
