The town of Gilbert and Big League Dreams contractor M.A. Mortenson Co. have not been able to resolve the outstanding repair issues at the ballpark.
The lawsuit filed by the town early last year, which had been stayed until mediation took place, will proceed. The lawsuit was filed because there are a number of structural defects, such as cracked concrete, erosion, uneven steps and loose handrails, at the baseball complex, at Power and Elliot roads.
“To avoid potentially expensive litigation, the town and M.A. Mortenson agreed to structure the litigation in a way that may allow for an early resolution,” Robert Grasso Jr. of Grasso Law Firm in Chandler and the lawyer representing Gilbert said in an e-mail.
