Attorney General Mark Brnovich on Thursday disavowed an opinion he issued earlier this year which said publicly financed “education” campaigns on pending ballot measures need not be fair and balanced.
In a new formal opinion, Brnovich said he had overlooked a 2013 change in state law which he now concedes prohibits taxpayer dollars from being used for one-sided arguments. What that means, he said, is anything prepared with public funds must be done in “a neutral or impartial manner.”
Comment by Rose Law Group Partner Ryan Hurley:
I applaud the AG for living up to both the spirit and the letter of the law. Public funds should not be used to influence voters period.
