Federal appeals court lets stand ruling favoring tribe’s right to operate casino

A federal appeals court has upheld its previous decision allowing a southern Arizona tribe to maintain its casino operation in the WestValley just outside Glendale.

The U.S. Court of Appeals for the Ninth Circuit Thursday rejected a request by the casino’s opponents to reconsider its decision affirming the Tohono O’odham Nation’s right to conduct casino gaming at its new Desert Diamond Casino.

The ruling effectively ends litigation over whether the tribe legally has a right to operate the casino.
