Tohono O’odham Nation has another hurdle to clear

The Tohono O’odham Nation was in familiar territory last week – United States District Judge David Campbell’s courtroom in downtown Phoenix. And once again, the TON will have to produce documents related to the creation, formation and development of what is now the Desert Diamond Casino West Valley with respect to the Arizona Gaming Compact that resulted from the voter-approved Proposition 202 passed in November 2002.

The Compact updated regulatory parameters for Class III gaming activities and required the tribes to make monetary contributions to the state based on the net revenues received from gaming operations. Proposition 202 also assured Arizona residents that no additional casinos would be built within the Phoenix area for up to 23 years.
