EEOC dismisses age discrimination complaint against Page

The Equal Employment Opportunity Commission has dismissed one of three charges of discrimination filed by former City of Page employees sent off in April as part of an eight-person Reduction-in-Force, the Page city attorney said Friday.

City Attorney Robert Wingo said EEOC notified him Friday regarding charges filed by Ernest Rubi, the city’s former community development director. Rubi was joined in a November notice of claim by Larry Clark, former fire chief, and Howard Rosenberg, former fire marshal.

Rubi, 58, Clark, then 71 and Rosenberg, 52, alleged age discrimination as part of their claim, filed by Prescott attorney Andre Carman. Rubi’s claim also alleged racial discrimination because he is Hispanic.

Wingo said he expects the claims by Clark and Rosenberg will receive similar notices of dismissal. The trio is seeking $3.3 million in damages.
