Phoenix declares victory in Sky Harbor rideshare fee fight.

By Mike Sunnucks | Rose Law Group Reporter

The city of Phoenix is claiming victory in the fight over increased fees on Uber and Lyft rides at Phoenix Sky Harbor International Airport.

The city issued a statement this morning saying the Arizona Supreme Court has upheld an ordinance to raise the rideshare fees. Arizona Attorney General Mark Brnovich had challenged the fee increase saying it violate a voter approved state measure restricting local tax hikes on services.

Uber and Lyft have both said they will pull rideshare services from Sky Harbor if the higher fees are put in place.

Here is the city’s statement on the Arizona Supreme Court actions on the case:

“Today, the Arizona Supreme Court issued their order on the 1487 litigation regarding airport ground transportation fees at Phoenix Sky Harbor.  The court unanimously upheld the city’s ordinance implementing the fees on rideshare ground transportation providers at Sky Harbor International Airport.

Amidst the global pandemic of COVID-19, this is a seemingly small victory. However, it is proof positive that cities have equal weight in the eyes of law when making decisions impacting our shared future. This ruling will allow all companies that do business at the airport to equally participate in its financial recovery from COVID-19.”
