Prescott’s City Attorney search raises legal issues

After interviewing four finalists for the Prescott City Attorney post on Monday, the Prescott City Council reportedly chose a top candidate during a closed-door executive session on Thursday.

According to an expert on the Arizona Open Meeting Law, however, that move violates the requirements of state law.

Dan Barr, an attorney with the Arizona First Amendment Coalition, said Thursday afternoon that state law is explicit on the matter.

“The Open Meetings Law forbids public bodies from either making a decision or reaching a consensus in executive session,” Barr said. “It couldn’t be more clear.”
