Business interests are battling liability attorneys over a bill at the Arizona Legislature to prohibit lawsuits in workers’ compensation cases. House Bill 2455 changes the state’s workers’ compensation laws on whether injured employees can sue insurance companies or claims processors over denied benefits.
Statement by David Weissman: “It seems to make sense to allow the agency most familiar with workers’ compensation issues – the Arizona Industrial Commission – to adjudicate all claims related to workers’ comp coverage. The administrative law judges at that agency deal with those issues every day and can resolve these disputes most efficiently. As a result of resolving these disputes more efficiently (i.e., faster and at a lower cost), as well as limiting the amount of recoverable damages, the costs for everyone involved in the workers’ compensation system are likely to go down.”
