The Tohono O’odham Nation has not proved it will suffer irreparable harm or financial losses from the state’s actions to try to block the tribe’s $200 million casino from opening in the West Valley.
Judge David Campbell of the U.S. District Court of Arizona made that initial ruling Thursday in the tribe’s lawsuit against the Arizona Department of Gaming and state officials over certification of its casino.
He refused to grant the tribe an injunction against the state gaming agency, saying it was not clear the Tohono O’odham Nation would prevail in its case.
But the judge also noted that the state conceded it does not have the authority to regulate Class 2 casinos, which are limited on the type of gaming allowed.
