Paradise Valley prevails in opposition to drug rehab facility

In an order issued at about 4:45 pm Tuesday, the hearing officer who was set to hear the reasonable accommodation hearing for the Blue Sands drug rehabilitation facility proposed to be located on an entirely residential street (Sunnyvale) in Paradise Valley issued an order dismissing the case entirely because a homeowner, Thomas Hopkins, was found not to have a valid lease in place with the California rehab operator.

Jordan Rose, founder and president of Rose Law Group, representing the surrounding Sunnyvale neighbors said, “Tthis is the sixth case we have won in the past 8 months where a neighborhood prevailed against out-of -state operators trying to set up a business in a totally incompatible location.

“Single family large home communities are under siege by these out of state interests seeking to sneak a busy business into our totally residential communities,” Rose said. “We are pleased with this result and thanks to the passion of the neighbors, Sunnyvale will remain residential in character.”

ORDER

On April 17, 2017, Blue Sands Recovery Center, L.L.C. (“Blue Sands”) filed a

Town of Paradise Valley Request For a Reasonable Accommodation Form, Request No 17-01, for the property located at 7102 E. Sunnyvale Rd., Paradise Valley, AZ 85253,

Assessor Parcel Number: 174-30-006 (the “Property”).

After consultation with counsel, a hearing on the Request For a Reasonable

Accommodation was set on Wednesday, May 31,2017. The hearing was continued to

June 27, 2017 . On June 20, 2017 , the Hearing Officer and all parties were advised that

Blue Sands and the owners of the Property did not have a signed agreement as to Blue

Sands occupancy or ownership of the Property.

The application was submitted for this Property, which is no longer subject to Blue

Sands’ occupancy or ownership. Accordingly, the hearing is moot and cancelled.

This Order is not intended to restrict Blue Sands’ opportunity to reopen the

Reasonable Accommodation Hearing as to this property.
