Lake, Finchem lawsuit to ban voting machines tossed due to lack of evidence of problems

A federal judge has dismissed a lawsuit from Kari Lake and Mark Finchem that sought to block the use of electronic voting machines in the November election.

U.S. District Court Judge John Tuchi said the two Republican candidates lacked standing to sue, noting they only offered hypothetical examples of how using machines to tabulate votes would compromise election integrity.

“While the court agrees with plaintiffs that the right to vote is precious, and should be protected, plaintiffs lack standing because they have articulated only conjectural allegations of potential injuries,” Tuchi wrote. In addition, the federal courts are not the place for disputes over election management, he wrote, since the U.S. Constitution gives that duty to the states.

“Simply put, plaintiffs have not alleged facts to show that it is plausible that the field is ’tilted’ here,” Tuchi wrote.
