The battle to remove 670 Sissoo trees in the upscale Arcadia at Silverleaf remains entangled in a cluster of administrative challenges and court battles.
Maricopa County Superior Court Judge Randall Warner affirmed on Sept. 12 the homeowners association needed a majority vote of all residents in the neighborhood to legally increase monthly fees more than 20% to pay for the tree removal, which it started doing in fall 2021 without a vote.
So the homeowners association went back and raised monthly dues 19.5% this month.
That has not sat well with some homeowners who have petitioned a meeting to discuss the situation and will have their day Jan. 13.
Resident Tom LaPorte and others feel the increase was not necessary and are calling for a vote on the issue.
“They’re claiming we don’t have that right (to vote), and we believe we do,” LaPorte said.
