Fresh off a loss at the Arizona Supreme Court, Superintendent Tom Horne, or his wife rather, is lodging one last-ditch effort to declare dual language education illegal, while Attorney General Kris Mayes and the Creighton Elementary School District deem the lawsuit doomed.
Horne has long been on a crusade to outlaw dual language immersion, a learning model that allows English language learners to be taught half a day in English and half a day in their native language, claiming it violates a ballot measure that requires students learning the language to be taught in English.
But his own litigation was rejected by the superior court and the Court of Appeals, given Horne’s inability to bring the lawsuit and his failure to name the correct parties.
The Arizona Supreme Court then refused review.
With little success on his own legal bid, Horne’s wife, Carmen Chenal Horne, filed a lawsuit against Creighton Elementary School District, on behalf of Patricia Pellett, a parent of a high school student.
