Rose Law Group attorney and Cave Creek Vice Mayor, Adam Trenk, said Cave Creek approved negotiations to settle easement suit “in an effort to end litigation that unnecessarily wastes tax payer resources”

A Cave Creek resident and the town could settle a lawsuit over an easement dispute in the northern part of town out of court.

Last year, Gerald Freeman sued Cave Creek over the use of a shared roadway that leads to a nearly 1,000-acre property owned by Minnesota-based Cahava Springs, which is also named in the suit.

On Monday night, the Town Council voted to allow the town to proceed into negotiations with Freeman and his lawyer, Steven Mahaffy.

Attorney Fredda Bisman, representing the town, said any settlement between the parties must come back to the council.
