Johnson Utilities attorneys have filed a motion to disqualify Commissioner Andy Tobin from all proceedings involving the company’s cases on the Arizona Corporation Commission docket.
The motion argues that Tobin “should be disqualified because his continued involvement would taint any result in which he would participate in his quasi-judicial role.”
The motion cites a private meeting that was held after the commission canceled a special meeting in which it was to possibly make a decision on the appointment of an interim manager to Johnson Utilities. It argues that Tobin has already made up his mind. On July 6, Tobin, Pinal County Supervisor Mike Goodman and Arizona Rep. T.J. Shope, R-Coolidge, met privately along with representatives from the Arizona Department of Environmental Quality.
