Court rejects $500K claim against Pinal County

An appellate court has ruled in favor of Pinal County’s request to dismiss a lawsuit from a private contractor seeking over $500,000 in damages.

NGU Contracting filed a lawsuit last year, accusing Pinal County of breaching a contract by not paying extra labor and material costs for a public works project near Maricopa.

On Aug. 28, the Arizona Court of Appeals reversed a Pinal County judge’s decision not to dismiss NGU’s lawsuit.

The appellate court agreed with Pinal County that NGU’s notice of claim, a document filed before a lawsuit, was “insufficient” and did not comply with Arizona law.
