A downtown Gilbert business owner is challenging the town’s use of eminent domain to take a portion of his property.

The town of Gilbert wants 1,560 square feet of Marc Barlow’s property at Gilbert Road and Hearne Way.

Gilbert plans to use Barlow’s property to expand Gilbert Road and reconfigure Hearne into a one-way road that will lead to a new restaurant and parking garage on the north end of the bustling Heritage District.
