Cave Creek is appealing a Maricopa County Superior Court judge’s order for the town to pay $7,100 in lawyer fees for a case in which Town Council incumbent Dick Esser dropped out of a race, but then rescinded his withdrawal after approval from the town.
In March, three incumbents — Shelley Anderson, James Bruce and Esser — dropped out of the runoff shortly after they qualified for it in the March 12 primary election.
However, Esser decided to rescind his withdrawal after approval from the town, causing outrage from some candidates and Cave Creek residents. The move prompted a legal challenge from resident Gerald Freeman.
